I am the brand owner and am brand registered through Amazon. I went through the trademark accelerator program on Amazon. My trademark is still pending with the USTPO.

I have been having Fake Chinese Sellers selling on my listing. They come on drop the price and are ruining and tarnishing my business AND brand. I have tried reporting abuse through the report abuse tab, Amazon does nothing. I have tried to report the seller through Brand Registry but they say they can't do anything because my trademark is still pending. I tried contacting Amazon seller support and they tell me to report it through brand registry (which doesn't work) or report abuse tab (which hasn't worked either). I am exhausted and have had to drop my price dramatically to try and make sure no one buys the fake Chinese item but this has resorted to dropping far below my MSRP, tarnishing my business & brand. I have ordered an item from this seller but the shipping won't get here til October 20th so I can report is as counterfeit with test buy but even then, I don't feel confident AMZ will do anything. AND it is still almost 3 weeks of having a fake seller selling counterfeit goods on my platform. How is this legal?

I make the product out of my house, I DO NOT sell wholesale and DO NOT sell to distributors. I only sell direct to customer through Amazon only. I have no leaky supply chain, that is impossible. However, that is the response I get from seller central, that they can't enforce agreements with distributors/leaky supply chain but I have told them over a hundred times I am the SOLE seller of the product. No wholesale, No distributors.

Legally, Amazon has been aiding and abiding these fake Chinese sellers to sell counterfeit goods of my brand on Amazon! I have applied for the trademark and it is pending but I find it so hard to believe I have NO legal protection in this case? I made the brand, I produced the product, and someone comes along and is selling fakes and that is okay? Amazon won't listen to me. What do I do?

Also ICING ON THE CAKE! This Chinese seller had 20 items in stock and now has 15 so they have been able to get some sales. If I get a negative review on my listing for this item, Amazon WON'T remove it because in their eyes this seller was supposed to be there and is allowed to be selling fakes WHEN THEY HAVE NO AUTHORIZATION. This can't be legal!!

I have opened numerous cases before about this issue and still get the same "we can't help" runaround. I have opened a new case: 16326556181 here for Dougal to look into.

I'm about to close up shop. I was never high volume, but I used to have 10-15 sales per week, now I go for days without a single sale. I have new and used but nothing seems to sell any longer.

My brand on 9 ASINs was changed to unknown brand. I followed the steps that suggested in seller forum to report abuse. I entered all ASIN then searched. The system listed all the products then asked us to select the ASIN to report by checking the box next to each ASIN. But I can't check the box because there is message in each product said "you can't select the complete ASIN, because it is connected to you or your brand". The seller support instructed me to do following steps

1. Navigate to your Contact Us page found on the Brand Registry Account

2. Select Report a marketplace policy violation from the drop down menu

3. Select Other marketplace policy violations

4. Use this form to report Product Detail Page Abuse. If you are reporting more than one seller, please submit each issue separately.

5. Describe their specific concern with the Product Detail Page Abuse you are reporting

6. Once the form is completed, hit the Send button

Which way is correct? Reporting abuse or reporting a marketplace policy violation? I had tried both of ways. Neither of them works. My brand was hijacked from unknown brand appeared with only letters. Would someone give me any ideas how to fix it? Thank you very much for your time.

My case number with seller support is ID 16325669011. These are ASINs which have the unknown brand: B07C1R49XJ, B0763CPN7Q, B01N95NYVE, B01N91IAXB, B00PVM7M44, B00PVM7K82, B00P87UKYG, B00LAUHG06, B00JDZPVCK .

Hello,

I applied for Amazon Brand Registry for my brand, Pawadise Parlor, and submitted all the required information, including my EIN number and business documents. However, my application was rejected. CASE NUMBER : 16044583531

The message from Amazon stated that my business name and business identifier (like EIN) couldn't be verified. I’m confident that all the information I provided is correct and all the documents are complete.

I would like to understand what caused this rejection and if there’s anything I need to correct or any additional documents I should provide.

Has anyone else experienced this issue? I would appreciate any advice on how to resolve it.

I have a Chinese seller that I have an active lawsuit against for copyright infringement. Their listing has already been pulled. They relisted again after they have been informed about the lawsuit. I am actively serving them at this moment.

I opened yet another complaint about copyright infringement a week ago on their new listing and have yet to hear any response from Amazon even though their feedback was stated as 1 to 2 days for a response. The complaint is still pending review.

How do I expedite this complaint? I have tried to use the proper channels to expedite my request but got this response:

This is not the correct channel to submit your request. We are only able to process requests regarding previously submitted reports of infringement.

No idea why that doesn't pertain to my case as it appears to be exactly what I am doing.

I'm having trouble registering my brand on Amazon due to an issue with my Turkish company’s tax ID. Even though I’ve double-checked that everything matches the details in my USPTO application and my company information, Amazon seems unable to verify the tax ID.

Hello,

"We are unable to approve your Brand Registry application because the trademark on the application either violates the intellectual property rights of others and/or is highly likely to be confused by customers for an established brand. To protect the shopping experience of our customers, we are limiting the volume of brands with similar names at this time. "

Struggling to understand the reason why my brand registry is not approved. I'm not sure how are we expected to resubmit differently when we don't know the exact reason:

1) a simple amazon search of my brand won't return anything close or similar to the category to which I applied.

2) my design logo is nowhere similar in amazon or USPTO

3) my trademark application is not rejected

4) the attorney who applied for my trademark made sure that the class/category doesn't have a similar brand name.

What am I missing?

Hello

My product is made up of 3 parts. However, these sellers were missing parts, which led to many negative reviews from customers who received products that did not match the description.

I tried to use the Report abuse of Amazon policies feature. However, Amazon did not take any action.

So, I tried to buy the products that these sellers were selling. Indeed, it was missing parts and used the wrong product size as described. I tried to report it through the Report a marketplace policy violation => Product not as described feature in the Amazon brand registry. However, Amazon still did not take any action.

So, I used the Report a violation => Trademark => feature and provided Amazon with the information of the products I was selling and the products I received from these fake sellers. Amazon took action by removing their listings.

However, yesterday I received a notification from Amazon about my abuse of Report a violation to report. Which led to my access being revoked.

I understand my Brand has not been approved by the USPTO, but counterfeit sellers are selling incorrect products, missing ingredients, and using my brand on products that I can’t report?

Is there a support department at Amazon that is helping counterfeit sellers from China? I am wondering about this.
