Systematic Death by Bot Category Moves, Category Fee Changes and Slow Compliance Review Process

So let us expound upon this Amazon saga ...

First, Amazon notified us in November 2024 that our products would be moved into a new category. This move would increase our fee from 15% to 20%. We were under the impression that our original category was going away (which is a category we helped Amazon establish 12 to 13 years ago for product like ours). In December 2024, our fee did increase to 20% but the product didn't change categories nor has the original category been removed from the node and hasn't been changed on our product. So we recognize this as a change in fee % rather than a category change as the original notice from Amazon announced. Okay, it is what it is and we moved on.

Second, Amazon on December 27, 2024 and December 28, 2024 pulled 11 of our listings under for compliance. This didn't appear to be an issue for us to complete (at first) as we had the needed testing report and certification to submit. We provided the certification and image requested. Now is when the fun begins.

On our next submission, we supplied both the certification and testing report (item #4), a new image (item #3), updated the Age Grade for each ASIN (item #1) and updated the CPSIA Warning Attribute (item #2).

We were rejected again. However, this rejection showed that we had solved item #4 with compliance testing and item #1 with the Age Grade. Item #2 had us scratching our head as we had updated the CPSIA Warning Attribute with the selected value of "NO WARNING APPLICABLE" which is matching the Safety Testing Report but was still being rejected. The issue with the CPSIA Warning Attribute is that it is no longer called that on the excel templates or in the Manage Inventory Edit pages. CPSIA Warning Attribute is now called "MANDATORY CAUTIONARY STATEMENT". Amazon has changed the attribute name and has not updated their help pages as shown here. We know this because the values shown on the help page are the same values listed under "MANDATORY CAUTIONARY STATEMENT".

On item #3, we researched the requirements and found that they were a little different from our original labeling. It appeared that the use of LOT verses BATCH was causing our issue as the other 3 requirements hadn't changed. We changed the labeling and created new packaging images with the new labeling.

Now ... we could only submit the new image and challenge the CPSIA Warning Attribute on 8 of the items as 3 of them were still under review (which we knew would be rejected based on the 8). The 3, that we couldn't resubmit, we sent an email with the attached new image and documentation about the CPSIA Warning Attribute.

Our results of the 8 with submission ...

  1. One ASIN caseID=16944083151 was accepted 2 days after submission.
  2. The following 7 ASIN are still Under Review 12 days later and counting

The results of the 3 ASINs with the email follow ups

  1. One email for caseID=16944158811 received a reply 7 days later that rejected it but it released the Under Review so that we could submit the new image through the compliance page.
  2. The other two emails for caseID=16944163301 and caseID=16943710901 received replies that said they were still Under Review and so the compliance page sits with no way for us to upload the new image.

The frustrating part now is that we know that all of the ASINs meet the compliance by the fact that they are all the same (except the design we put on top as we do custom products) as caseID=16944083151 which has already been approved and yet we wait on Amazon to review.

We know that we are not the only one in the extremely slow review process as we have seen several posts here on the forum that document similar experiences with CPC compliance issues.

So we got a response on caseID=16944128021 today 01/21/2025.

On 01/06/2025, the test report was accepted and the subject in in each email response from Amazon since then has contained ...

"Test reports from an CPSC accepted laboratory that show that the product complies with the regulations, standards, and requirements listed in the help page"

On 01/21/2025 today, the response shows that the image and compliance warning issues have been resolved but we need to re-submit test reports again even though the email subject line clearly states that we have met that requirement.

Again as a reference, we would note that caseID=16944083151 has been approved and is just a different design on top (remember ... we do custom product and offer these types of designs).

We are now approaching a month on these 10 items.

It would be nice to get a mod response.

Thank you for looking into.

16943859521 , 16944158021 and 16944158811 were just denied again this morning for issues with the test report which the test report was accepted for all 3 of these on January 6, 2025 and was also accepted for all 6 of the ones that are already approved. When we went to appeal each of these, the appeal created a blank input with a new case id. When we saw this, we resubmitted the same items that we had already submitted. It is like being back to square one.

16944163301 and 16943710901 have been sitting since January 1, 2025. On January 10, 2025, we sent in an inquiry for them as all of the rest had been responded to. On January 17, 2025, we got replies for both of them that they were still under review. So the 10-15 days last already passed. We know we need to upload new images as that is what the other 9 needed. We haven't been able to do this because of sitting in the "Under Review" status. In the inquiry, we attached the new image but it didn't seem to help.

This Amazon team is in India and works 8am to 5pm their time which is graveyard hours for the US.

It has been a luck of the draw when it comes to the person reviewing and their actual knowledge of the compliance and Amazon's attributes that have been renamed.

For CASE ID 16944163301 and 16943710901, I have escalated to the Compliance team.

CASE ID 16944163301 was approved last night. When the approval came down on this, we received two notifications ... one through CASE ID 16944163301 and one through another case which wasn't part of our cases before ... CASE ID 17101545061 .

CASE ID 16943710901 did not have a response last night. If you submitted both CASE ID 16944163301 and 16943710901 in the same escalation, then they completed one and closed the escalation CASE ID 17101545061 before looking at the second CASE ID 16943710901.

CASE ID 16943859521 was rejected yesterday just like CASE ID 16944128021 ❌ and CASE ID 16944158811 ❌. We received the email notice but, when you look at the compliance page, it still shows Under Review. However ... when you view this case through the View Compliance button, you can tell that it was rejected as the submit button is active.

We researched our emails and found the exchange where the testing company asked what Age Grading we were needing and have our reply response as "Age 3 and up to adult". This is what trigger the testing under ASTM F2923-14 which is the testing done for the age 3 to age 12 (NOTE: ASTM F2923-20 was not yet in effect in 2019 when the testing was done as it came into being in 2020). In addtion, the changes made with ASTM F2923-20 over ASTM F2923-14 would not have effected our product nor the results of our testing as none of the materials added into ASTM F2923-20 are present in our product.

On CASE ID 16944128021 ❌, CASE ID 16944158811 ❌, and CASE ID 16943859521 ❌, we are going to resubmit the documents again today and include a PDF copy of email exchange with the testing company on the age grading. On CASE ID 16943710901, we will wait another day to see if your escalation is possibly still in the works.

We have 3 that are still stuck.

caseID=16944128021 - we reopened the appeal that was denied 1/27/2025 which has the related appeal caseID=17090400671

caseID=16943859521 - we attempted to reopen appeal but this one was stuck as Under Review although the appeal caseID=17089948771 was denied 1/27/2025 - we resent an email to the original caseID=16943859521 with appeal information but couldn't reopen the appeal case.

caseID=16944158811 - we reopened the appeal that was denied 1/27/2025 which has the related appeal caseID=17090148961

All 3 were rejected because of the testing report which doesn't make sense as the other 8 have been approved with the testing report.

Again ... appreciate your help

Yes ... all 3 were denied again within hours of us submitting again.

The denial is because of this:

1. We are contacting you because the age that your product was tested for is not included in the test report submitted.

The report was accepted for the other 8 items and meets the original requirement that the report shows:

No there is not. This is the same testing report that was accepted for the 8 ASINs that were approved. We have the original email exchange with the testing company where they asked what age grading we were seeking and we replied "Age 3 and up to adult". We provided that exchange in a PDF but didn't make a difference.

At one point, the test report was accepted as it was dropped from the needed items and then came back with the Age Grading thing on these 3 cases.

1/1/2025 Gave us all of the things we needed to do including providing test report

1/6/2025 Needed Image of product packaging showing certain elements and needed update CPSIA Warning Attribute in detail page with applicable warning - but no longer requesting test report

1/21/2025 and 01/27/2025 we got request for test report again

Then on 1/27/2025, the Age Grading requirement on the testing report appeared. This same flow of exchanges for these remaining 3 caseID has us pulling our hair out.

We don't understand why these 3 weren't accepted when the other 8 were accepted with the same test report. Once they got tagged with the Age Grading ... that was it ... even though the test report meets the original requirement request. When the test report was done 2019 and you were being tested under ASTM F2923-14, the item was being tested for children age 3+. That is what ASTM F2923-14 was for and was accepted by Amazon.

Update:

We contacted the testing company to have them update the testing report to include the Age Grading. Hopefully, we will get the updated testing report by next week.

The only update I heard from the Compliance Team was last night when they mentioned: "We are reviewing the concern raised. We will revert with an update." Hopefully the update will come soon. Systematic Death by Bot Category Moves, Category Fee Changes and Slow Compliance Review Process

So let us expound upon this Amazon saga ...

First, Amazon notified us in November 2024 that our products would be moved into a new category. This move would increase our fee from 15% to 20%. We were under the impression that our original category was going away (which is a category we helped Amazon establish 12 to 13 years ago for product like ours). In December 2024, our fee did increase to 20% but the product didn't change categories nor has the original category been removed from the node and hasn't been changed on our product. So we recognize this as a change in fee % rather than a category change as the original notice from Amazon announced. Okay, it is what it is and we moved on.

Second, Amazon on December 27, 2024 and December 28, 2024 pulled 11 of our listings under for compliance. This didn't appear to be an issue for us to complete (at first) as we had the needed testing report and certification to submit. We provided the certification and image requested. Now is when the fun begins.

On our next submission, we supplied both the certification and testing report (item #4), a new image (item #3), updated the Age Grade for each ASIN (item #1) and updated the CPSIA Warning Attribute (item #2).

We were rejected again. However, this rejection showed that we had solved item #4 with compliance testing and item #1 with the Age Grade. Item #2 had us scratching our head as we had updated the CPSIA Warning Attribute with the selected value of "NO WARNING APPLICABLE" which is matching the Safety Testing Report but was still being rejected. The issue with the CPSIA Warning Attribute is that it is no longer called that on the excel templates or in the Manage Inventory Edit pages. CPSIA Warning Attribute is now called "MANDATORY CAUTIONARY STATEMENT". Amazon has changed the attribute name and has not updated their help pages as shown here. We know this because the values shown on the help page are the same values listed under "MANDATORY CAUTIONARY STATEMENT".

On item #3, we researched the requirements and found that they were a little different from our original labeling. It appeared that the use of LOT verses BATCH was causing our issue as the other 3 requirements hadn't changed. We changed the labeling and created new packaging images with the new labeling.

Now ... we could only submit the new image and challenge the CPSIA Warning Attribute on 8 of the items as 3 of them were still under review (which we knew would be rejected based on the 8). The 3, that we couldn't resubmit, we sent an email with the attached new image and documentation about the CPSIA Warning Attribute.

Our results of the 8 with submission ...

  1. One ASIN caseID=16944083151 was accepted 2 days after submission.
  2. The following 7 ASIN are still Under Review 12 days later and counting

The results of the 3 ASINs with the email follow ups

  1. One email for caseID=16944158811 received a reply 7 days later that rejected it but it released the Under Review so that we could submit the new image through the compliance page.
  2. The other two emails for caseID=16944163301 and caseID=16943710901 received replies that said they were still Under Review and so the compliance page sits with no way for us to upload the new image.

On 01/06/2025, the test report was accepted and the subject in in each email response from Amazon since then has contained ...

"Test reports from an CPSC accepted laboratory that show that the product complies with the regulations, standards, and requirements listed in the help page"

On 01/21/2025 today, the response shows that the image and compliance warning issues have been resolved but we need to re-submit test reports again even though the email subject line clearly states that we have met that requirement.

Again as a reference, we would note that caseID=16944083151 has been approved and is just a different design on top (remember ... we do custom product and offer these types of designs).

We are now approaching a month on these 10 items.

It would be nice to get a mod response.

16943859521 , 16944158021 and 16944158811 were just denied again this morning for issues with the test report which the test report was accepted for all 3 of these on January 6, 2025 and was also accepted for all 6 of the ones that are already approved. When we went to appeal each of these, the appeal created a blank input with a new case id. When we saw this, we resubmitted the same items that we had already submitted. It is like being back to square one.

16944163301 and 16943710901 have been sitting since January 1, 2025. On January 10, 2025, we sent in an inquiry for them as all of the rest had been responded to. On January 17, 2025, we got replies for both of them that they were still under review. So the 10-15 days last already passed. We know we need to upload new images as that is what the other 9 needed. We haven't been able to do this because of sitting in the "Under Review" status. In the inquiry, we attached the new image but it didn't seem to help.

This Amazon team is in India and works 8am to 5pm their time which is graveyard hours for the US.

It has been a luck of the draw when it comes to the person reviewing and their actual knowledge of the compliance and Amazon's attributes that have been renamed.

CASE ID 16944163301 was approved last night. When the approval came down on this, we received two notifications ... one through CASE ID 16944163301 and one through another case which wasn't part of our cases before ... CASE ID 17101545061 .

CASE ID 16943710901 did not have a response last night. If you submitted both CASE ID 16944163301 and 16943710901 in the same escalation, then they completed one and closed the escalation CASE ID 17101545061 before looking at the second CASE ID 16943710901.

CASE ID 16943859521 was rejected yesterday just like CASE ID 16944128021 ❌ and CASE ID 16944158811 ❌. We received the email notice but, when you look at the compliance page, it still shows Under Review. However ... when you view this case through the View Compliance button, you can tell that it was rejected as the submit button is active.

We researched our emails and found the exchange where the testing company asked what Age Grading we were needing and have our reply response as "Age 3 and up to adult". This is what trigger the testing under ASTM F2923-14 which is the testing done for the age 3 to age 12 (NOTE: ASTM F2923-20 was not yet in effect in 2019 when the testing was done as it came into being in 2020). In addtion, the changes made with ASTM F2923-20 over ASTM F2923-14 would not have effected our product nor the results of our testing as none of the materials added into ASTM F2923-20 are present in our product.

On CASE ID 16944128021 ❌, CASE ID 16944158811 ❌, and CASE ID 16943859521 ❌, we are going to resubmit the documents again today and include a PDF copy of email exchange with the testing company on the age grading. On CASE ID 16943710901, we will wait another day to see if your escalation is possibly still in the works.

We have 3 that are still stuck.

caseID=16944128021 - we reopened the appeal that was denied 1/27/2025 which has the related appeal caseID=17090400671

caseID=16943859521 - we attempted to reopen appeal but this one was stuck as Under Review although the appeal caseID=17089948771 was denied 1/27/2025 - we resent an email to the original caseID=16943859521 with appeal information but couldn't reopen the appeal case.

caseID=16944158811 - we reopened the appeal that was denied 1/27/2025 which has the related appeal caseID=17090148961

All 3 were rejected because of the testing report which doesn't make sense as the other 8 have been approved with the testing report.

No there is not. This is the same testing report that was accepted for the 8 ASINs that were approved. We have the original email exchange with the testing company where they asked what age grading we were seeking and we replied "Age 3 and up to adult". We provided that exchange in a PDF but didn't make a difference.

At one point, the test report was accepted as it was dropped from the needed items and then came back with the Age Grading thing on these 3 cases.

1/6/2025 Needed Image of product packaging showing certain elements and needed update CPSIA Warning Attribute in detail page with applicable warning - but no longer requesting test report

1/21/2025 and 01/27/2025 we got request for test report again

Then on 1/27/2025, the Age Grading requirement on the testing report appeared. This same flow of exchanges for these remaining 3 caseID has us pulling our hair out.

We don't understand why these 3 weren't accepted when the other 8 were accepted with the same test report. Once they got tagged with the Age Grading ... that was it ... even though the test report meets the original requirement request. When the test report was done 2019 and you were being tested under ASTM F2923-14, the item was being tested for children age 3+. That is what ASTM F2923-14 was for and was accepted by Amazon.

We contacted the testing company to have them update the testing report to include the Age Grading. Hopefully, we will get the updated testing report by next week.

We haven't been able to do this because of sitting in the "Under Review" status. In the inquiry, we attached the new image but it didn't seem to help.

This Amazon team is in India and works 8am to 5pm their time which is graveyard hours for the US.

It has been a luck of the draw when it comes to the person reviewing and their actual knowledge of the compliance and Amazon's attributes that have been renamed.

CASE ID 16944163301 was approved last night. When the approval came down on this, we received two notifications ... one through CASE ID 16944163301 and one through another case which wasn't part of our cases before ... CASE ID 17101545061 .

CASE ID 16943710901 did not have a response last night. If you submitted both CASE ID 16944163301 and 16943710901 in the same escalation, then they completed one and closed the escalation CASE ID 17101545061 before looking at the second CASE ID 16943710901.

CASE ID 16943859521 was rejected yesterday just like CASE ID 16944128021 ❌ and CASE ID 16944158811 ❌. We received the email notice but, when you look at the compliance page, it still shows Under Review. However ... when you view this case through the View Compliance button, you can tell that it was rejected as the submit button is active.

We researched our emails and found the exchange where the testing company asked what Age Grading we were needing and have our reply response as "Age 3 and up to adult". This is what trigger the testing under ASTM F2923-14 which is the testing done for the age 3 to age 12 (NOTE: ASTM F2923-20 was not yet in effect in 2019 when the testing was done as it came into being in 2020). In addtion, the changes made with ASTM F2923-20 over ASTM F2923-14 would not have effected our product nor the results of our testing as none of the materials added into ASTM F2923-20 are present in our product.

On CASE ID 16944128021 ❌, CASE ID 16944158811 ❌, and CASE ID 16943859521 ❌, we are going to resubmit the documents again today and include a PDF copy of email exchange with the testing company on the age grading. On CASE ID 16943710901, we will wait another day to see if your escalation is possibly still in the works.

No there is not. This is the same testing report that was accepted for the 8 ASINs that were approved. We have the original email exchange with the testing company where they asked what age grading we were seeking and we replied "Age 3 and up to adult". We provided that exchange in a PDF but didn't make a difference.

At one point, the test report was accepted as it was dropped from the needed items and then came back with the Age Grading thing on these 3 cases.

1/1/2025 Gave us all of the things we needed to do including providing test report

1/6/2025 Needed Image of product packaging showing certain elements and needed update CPSIA Warning Attribute in detail page with applicable warning - but no longer requesting test report

1/21/2025 and 01/27/2025 we got request for test report again

Then on 1/27/2025, the Age Grading requirement on the testing report appeared. This same flow of exchanges for these remaining 3 caseID has us pulling our hair out.

We don't understand why these 3 weren't accepted when the other 8 were accepted with the same test report. Once they got tagged with the Age Grading ... that was it ... even though the test report meets the original requirement request. When the test report was done 2019 and you were being tested under ASTM F2923-14, the item was being tested for children age 3+. That is what ASTM F2923-14 was for and was accepted by Amazon.
